This list of qualifying Porsche vehicles may be modified from time to time.
To apply for the Custodians by Porsche programme you must present your qualifying Porsche vehicle, with proof of ownership, at a participating Porsche Centre and sign and return the completed membership application. Only applicants of at least 17 years of age who reside at an address located in the United Kingdom will be considered for membership.
You must keep your identity and contact details as registered with us complete and accurate at all times. You may process changes at any time at your chosen Porsche Centre or the Porsche Customer Relations Hub on contact@porsche.co.uk.
Your membership of the Custodians by Porsche programme runs for two years (24 months) from the date of our agreement. Each membership accepted is specific to a single qualifying Porsche vehicle, identified by reference to the car’s Vehicle Identification Number on the member’s membership card (“the registered Porsche vehicle”). If you require membership for more than one qualifying Porsche vehicle a separate application for membership must be made for each qualifying Porsche vehicle in order to access membership benefits for each such vehicle.
During the 22nd month of membership your chosen Porsche Centre will send out a reminder to you indicating that your membership is expiring, at which point you will be invited to renew your membership by following the instructions given.
As a member of the Custodians by Porsche programme you may only take and consume the benefits derived from the membership programme as a consumer in the United Kingdom and pursuant to consumer protection rights existing under the laws of England and Wales, and in no other capacity. This is an eligibility condition. If at any time you are not acting as a consumer as indicated above, you must disclose such status in writing to your chosen Porsche Centre – this is an important disclosure obligation continuing for the duration of your membership.
Membership of Custodians by Porsche programme is neither available to consumers not resident in the United Kingdom nor sole traders, businesses or corporate entities.
We reserve the right to modify the programme known as Custodians by Porsche at any time for commercial, business, legal, regulatory or policy reasons by publishing notice of such modifications on our website. Such modifications as published may include changes to our agreement including the modification of benefits. If you do not agree with the modifications, you may terminate our agreement by giving notice in writing to your chosen Porsche Centre.
As your chosen Porsche Centre, we also reserve the right to terminate our participation in the Custodians by Porsche programme by publishing notice of such termination on our website. If we publish such notice, your rights under the Custodians by Porsche programme will also be extinguished.
Custodians by Porsche Benefits
As a member of the Custodians by Porsche programme you shall be entitled to the following benefits in respect of the registered Porsche vehicle*:
On joining, a welcome pack containing the Custodians by Porsche membership card, enamel badge, a copy of ORIGINALE magazine and further information on the programme
On any purchases of Porsche Classic Genuine Parts for your registered Porsche vehicle delivered within the applicable membership period, not less than a 15% discount on the then applicable recommended retail price (“RRP”) for those parts ordered (as such RRP is as published by PCGB from time to time)
A complimentary one-litre top-up bottle of Porsche Classic Motor Oil provided at each service of your registered Porsche vehicle completed during the applicable membership period
Eight requests** for complimentary vehicle wash and vacuums (joint, not separate) provided by your chosen Porsche Centre, and subject to a sequencing limit of four requests completed per membership per membership year**
Four requests** for complimentary nitrogen gas tyre top-ups or complete refills (up to four (4) tyres and a spare tyre per request) to be provided by your chosen Porsche Centre only, and subject to a sequencing limit of two requests completed per membership per membership year
Programme benefits may only be redeemed at, and will only be fulfilled by, your chosen Porsche Centre.
* The sale and purchase of and/or provision of any benefits such as Porsche Classic Genuine Parts, vehicle repair and maintenance services, vehicle wash and vacuum and/or nitrogen gas tyre top ups shall be completed on the normal terms operated by your chosen Porsche Centre from time to time for those benefits.
* For the purpose of the Custodian by Porsche programme, oil and lubricant products do not form part of the Porsche Classic Genuine Parts offer set out above.
** Advance bookings required, all bookings are subject to availability at the time of the booking request. At busy times, delays may unavoidably operate.
You acknowledge that your chosen Porsche Centre and/or PCGB will communicate programme benefits to you by post and/or by electronic communications, including via email.
Unless otherwise agreed by your chosen Porsche Centre, the benefits of the Custodian by Porsche programme cannot be combined with other offers extended by your chosen Porsche Centre and/or PCGB.
The fulfilment of the benefits will be undertaken by us as your chosen Porsche Centre for so long as, we, your chosen Porsche Centre continue to participate in the Custodians by Porsche programme.
The benefits of your membership are personal to you and can neither be assigned, transferred to any third party nor taken by you for the benefit of any third party.
The benefits of your membership are not fungible, and if not taken, such benefits cannot be exchanged or redeemed for cash or any other benefit type or stored value.
Any benefit not taken by you within the stated time limit shall be extinguished and cannot be banked, accrued and carried forward for redemption and/or consumption in any future period.
Our provision of the Custodians by Porsche programme benefits is without prejudice to any other products, services, promotions or offers that we may choose to offer in any combination in our discretion to any of our customers.
Unless otherwise agreed in writing with PCGB, you may not, including in respect of the registered Porsche vehicle, use the word marks Custodians by Porsche and/or Porsche 111 Point Check for any purpose, including without limitation, in respect of any communication, promotion, advertising and/or marketing of the registered Porsche vehicle or any other vehicle to any third party.
Acceptance of your membership and any vehicles connected to that membership into the Custodians by Porsche programme neither grants you nor any third party any right or permission to claim, represent, warrant, promise, guarantee or otherwise assure any third party as to the provenance, roadworthiness, status, condition, use, homologation, lawfulness and/or fitness for purpose of that vehicle by reason of such acceptance and/or membership. As a condition of your membership, you shall not do or omit to do anything to mislead any third party or permit a third party to continue under an equivalent misapprehension on the topics mentioned above to their detriment in respect of the registered Porsche vehicle, and you shall indemnify, and keep indemnified, your chosen Porsche Centre and PCGB from any loss and damage arising from or connected to such misrepresentation and/or misapprehension, accordingly.
General
Your membership of the Custodians by Porsche programme will end and our agreement will terminate and be at an end if:
You give us written notice that, in relation to personal data processed in connection with the Custodians by Porsche programme, you: (a) withdraw your consent to processing of your personal data, including for direct marketing purposes as granted in the application form; and/or (b) object to the processing of your personal data for the purposes of the Custodians by Porsche programme;
you give us written notice that you are withdrawing from the Custodians by Porsche programme; or
we give you written notice that we are withdrawing from the Custodians by Porsche programme; or
your membership period has lapsed by expiry of time; or
in the opinion of your chosen Porsche Centre, you or the registered Porsche vehicle are no longer considered eligible for Custodians by Porsche programme according to the programme criteria; or
you are no longer the owner of the qualifying car; or
you become resident is a location outside of the United Kingdom; or
we consider that the operation of Custodians by Porsche programme and/or the giving of any of the benefits would be a breach of law; or
the participation of your chosen Porsche Centre in the Custodians by Porsche programme is terminated as indicated above under the heading Eligibility and Duration.
If PCGB withdraws its support for the Custodians by Porsche programme, and in such circumstances, we will notify you in writing of such termination.
We will not be liable for any failure to perform, or delay in performance of, any of our obligations relating to your membership of Custodians by Porsche programme to the extent caused by an event outside our control (an ‘event outside our control’ means any act or event beyond our reasonable control, including without limitation severe road traffic congestion, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications, water, gas, electric or other utility networks).
If an event outside our control takes place that affects the performance of our obligations, we will contact you as soon as reasonably practicable to notify you and our obligations will be suspended and the time for performance of our obligations will be extended for the duration of the event outside our control.
In our agreement, any benefit or right granted to PCGB shall be enforceable by PCGB additionally, even though PCGB is not a party to our agreement. Otherwise, the Contracts (Rights of Third Parties) Act 1999 shall not apply to our agreement.
This document (and any non-contractual obligations arising in connection with it will be governed by English law and any dispute (whether in contract or tort) arising shall subject to the exclusive jurisdiction of the English Courts.
