Official Rules

 

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

 

1.         Sponsor; Tournament Operator

Porsche Cars North America, Inc., 1 Porsche Drive, Atlanta, Georgia USA 30354 ("Sponsor") is the sponsor of this Tournament.  Polyphony Digital Inc., on behalf of Sony Interactive Entertainment LLC is the operator of this Tournament (“Tournament Operator”).

 

2.         Eligibility

To be eligible to enter and win, “Participants” must: (a) be a legal resident of the United States; (b) be at least 18 years of age; (c) have access to a PlayStation® 4 or PlayStation® 5 console and a copy of Gran Turismo™ 7  (“Game”); (d) have a current PlayStation®Plus subscription as of the Opening  Date, (e) must maintain such ownership or access to the console, game,  and subscription throughout the Tournament Period, and (f) must meet all requirements described in, and agree to be bound by, all of the terms and conditions in these Official Rules. Employees or contractors of Sponsor, Tournament Operator, Sony Interactive Entertainment LLC and their affiliates, subsidiaries, and agencies (collectively "Tournament Parties"), and members of their immediate family or persons living in the same household are not eligible to enter the Tournament. In the case of a dispute, entries will be deemed made by the authorized holder of the applicable e-mail address used for entry. Automated entries are prohibited, and use of any automated devices in connection with the Tournament will result in disqualification. If a Participant fails to meet the eligibility conditions set out in clause 4, the Tournament Operator shall have the right to refuse their entry in the Tournament and/or immediately disqualify the offending Participant from the Tournament.

 

3.         Tournament Period

The Tournament shall take place in-Game from July 23, 2022 through August 13, 2022 ("Tournament Period"). Eastern Time shall control for all purposes of this Tournament. Tournament Operator’s clock shall be the official time-keeping device for all purposes of this Tournament.  The Tournament shall take place on four separate dates:

Round 1: Saturday 23 July

Round 2: Saturday 30 July

Round 3: Saturday 6 August

Round 4: Saturday 13 August

Each Round will consist of 3 available racing slots where racers can compete:

Slot 1: 8:00pm ET

Slot 2: 9:00pm ET

Slot 3: 10:00pm ET

Participants may participate in any race slot in any round at their discretion. However, only the points earned in their last race of the day will count towards their ranking for that round.

 

4.         How to Enter; Entry Guidelines

To enter the Tournament, eligible Participants shall compete in the Tournament inside the Game. LIMIT ONE ENTRY PER PERSON (NOTE: PERSONS WITH MULTIPLE EMAIL ACCOUNTS AND PEOPLE WITH MULTIPLE PSN IDs MAY ONLY ENTER ONCE). VOID WHERE PROHIBITED OR RESTRICTED. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. Cheating of any kind is prohibited and will result in disqualification. You may not enter more times than indicated by using multiple email addresses, PSN IDs, identities, or devices in an attempt to circumvent the rules. Proof of submission will not be deemed to be proof of receipt by Tournament Operator. For an Entry to be valid, Participant must provide the email address associated with their PSN account. The email address must be valid and the Participant must be the account holder of the email address. For purposes of these Official Rules, the “account holder” is the natural person associated with the submitted PSN account and email address. Potential winning participants and/or winning participants (as those terms are defined below) may be required to show proof of being the account holder. Any entries connected to an invalid, non-working, or inactive email address or PSN ID, or linked to an account holder other than Participant, are void and ineligible to participate or win. Tournament Operator is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, or for other submission, problems of any kind, whether due to causes mechanical, human or electronic, all of which are void and ineligible to participate or win. Additionally, Tournament Operator is not responsible for any telephone, electronic, hardware, software, network, Internet, computer, or console errors, malfunctions, failures, or difficulties. Tournament Parties will not be responsible for: late, incomplete, or incorrect entries; an entrant's failure to receive prize notices or other communications from Tournament Operator due to entrant's spam, junk e-mail, or other security settings or for Participants' provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this promotion; damaged or defective prizes; by any human error which may occur in the processing of the entries or in connection with any other aspect of the Tournament; bugs, error, delay or other issues with respect to the Game or the Tournament Platform (as defined below) or the shipping of prizes; theft, tampering, destruction, or unauthorized access to, or alteration of entries; or any typographical, technological, or other error in the publishing of the Tournament Announcement or any advertisement for a Tournament, administration of the Tournament, or announcement of the prizes (collectively “Error” or “Errors”). If, in the Tournament Operator's or Sponsor’s opinion, Tournament Operator or Sponsor detects an Error, or there is any suspected evidence of tampering with any portion of the promotion, or if technical difficulties (including viruses and bugs) compromise the integrity of the promotion, Tournament Operator or Sponsor reserve the right, in its sole discretion, to cancel or modify the Tournament in a manner deemed appropriate by the Tournament Operator or Sponsor. In the event a dispute arises as to the identity of a potentially Winning Participant, Winning Participants will be declared made by the name associated with the Winning Participant’s email account. No more than the advertised number of prizes will be awarded.

 

5.         Representations and Warranties/Indemnification

Each person who enters this Tournament represents and warrants that s/he will abide by and comply with these Official Rules.  Each entrant further represents and warrants that the entry s/he submits does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks, or rights of privacy or publicity, and will not violate any federal, state, or local laws or ordinances.  Each entrant hereby agrees to indemnify and hold harmless Tournament Entities from and against any and all third-party claims, actions, or proceedings of any kind and from any and all damages, liabilities, costs, and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations, or agreements of entrant hereunder.

 

6.         How to Win

Participants will accumulate their total points gained throughout the Tournament, where points are earned based on their position in the race as well as the average driver rating of the Participants they race against in a given race. To determine Participants’ overall ranking, points will be tallied at the end of each round and the Participant’s final score is based on his/her best two (2) rounds (the “Final Score”). Participants will be ranked in the “Online Ranking” based on their Final Score, and the top 12 ranked Participants (the “Winning Participants”) in the Online Ranking will win an invitation to the Sports Car Together Festival (the “Top 12 Prize”) to compete in a Tournament “Finals” (rules for Tournament Finals will be provided by Tournament Entities prior to the commencement of the event).  If two or more Participants are tied with an equal number of points in the Online Ranking, the Participant(s) with the highest points scored across all rounds (as opposed to top 2) will be the Winning Participant.  If there is still a tie, the Participant with the highest points scored in a single round will be the Winning Participant.

7.         Prizes

 

All Participants (who participate in one of the rounds) and are ranked will be awarded an in-game Porsche Vision GT Spyder car model which they will be able to unlock in the Game (“In-game Reward”). (In-game Rewards have no retail value or application outside of the PlayStation Network, and may not be sold, transferred, or redeemed for real money or items of value.).

The Winning Participants (the top 12 ranked Participants) will win a trip to the Sports Car Together Fest and an opportunity to participate in the Finals (the “Prize”) which includes: (i) roundtrip airfare to and from the Indianapolis Airport (or a nearby airport in Sponsor’s sole discretion), (ii) hotel accommodations for 3 night(s) at the hotel of Sponsor’s choice, and (iii) and a 3-day admission ticket to the Porsche Sports Car Together Fest . Approximate retail value of $1,000 (value varies based on origin destination).  The ARV for travel prizes is an estimate made before the Promotion begins and may vary depending upon points of departure and destination and fare fluctuations. The winner will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules.

The Prize does not include transportation to/from any airport, meals, or any expenses associated with travel or the event other than those expressly stated above.  All other expenses and incidental travel costs are the sole responsibility of the Winning Participant. 

 Winning Participants’ participation in the Finals will be subject to separate terms and conditions.

Prizes may not be sold, auctioned, offered for sale, assigned, transferred, offered for transfer, photocopied, duplicated, or redeemed or exchanged for cash, merchandise, or services, except by Sponsor, in its sole and absolute discretion, who reserves the right to substitute Prize with a prize of comparable or greater value if Prize becomes unavailable. 

 

Each Winning Participant is solely responsible for all federal, state, and local taxes and other fees associated with Prize receipt, regardless of whether Prize is used in whole or in part.  Winners of a prize valued at $600 or more will receive a Federal Tax Form 1099. We recommend that you consult with your tax advisor if you have further questions.  Prizes and In-Game Rewards are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winning Participants may be required to sign an affidavit in connection with acceptance of the Prize at Sponsor’s sole discretion. Any Winning Participant who fails or refuses to sign and return the required documentation within the time period as specified by Sponsor will be disqualified.

 

8.         Odds

Odds of winning the Prize depend on the number of eligible entries received.

 

9.         Winner Notification/How to Claim Prizes

Between the dates of August 13th and August 26th, 2022, Sponsor or its representatives will attempt to notify the potential Winning Participants.  If the potential winners do not meet eligibility criteria or are otherwise unwilling or unable to comply with these Official Rules, or cannot be contacted successfully, potential winners may be deemed, in Sponsor’s sole discretion, to have forfeited a Prize, and alternate potential winners may be selected.  Those who do not win will not be contacted.

 

10.       Publicity 

Except where and as may be prohibited by law, participation in the Tournament and acceptance of a prize constitutes express permission of each winner for Sponsor and those acting pursuant to the authority of Sponsor to use such winner’s entry, name, photograph, image, likeness, voice, opinions, city, state, and country of residence for advertising, trade, promotion, and publicity purposes in all forms of media now known or hereafter discovered or devised, worldwide in perpetuity, without further notice, review or approval, or compensation.

 

11.       General Conditions

This Tournament is subject to all applicable international, federal, state, and local laws and regulations.  Tournament Entities are not responsible for incorrect or inaccurate entry information, whether caused by any of the equipment or programming associated with or utilized in the Tournament, or by any technical or human error, which may occur in the processing of the Tournament entries.  Tournament Entities are not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled, or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical, or electronic or for any damage to any person’s computer, phone, tablet, or other device related to participating in the Tournament.  By participating in this Tournament, Participants waive any right to claim ambiguity in these Official Rules.

 

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS TOURNAMENT IS A VIOLATION OF CRIMINAL AND CIVIL LAWS.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right, in their sole discretion, to modify, cancel, or suspend this Tournament and award the Prizes in accordance with the winner selection process described above from among all eligible entries received as of such date should fraud, virus, bugs, or other causes beyond Sponsor’s control corrupt the administration, fairness, proper play or security of the Tournament.  Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  Sponsor reserves the right, in its sole discretion, to disqualify any individual it or its designees find to be attempting to tamper with or undermine the entry process, any website or social media account or page associated with this Tournament, and/or the legitimate operation of the Tournament; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.  Tournament Entities are not responsible for: (a) any incorrect or inaccurate information, whether caused by Participants, printing errors, or by any of the equipment or programming associated with or utilized in the Tournament; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Tournament; (d) technical or human error which may occur in the administration of the Tournament or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Tournament or receipt, use, or misuse of any prize. All decisions of the Sponsor with regard to the Tournament are final and binding in all respects.

 

13.       Limitations of Liability

By participating in this Tournament and/or accepting a prize, each participant agrees to release Tournament Entities from any and all liability whatsoever for any injuries, losses, illnesses or damages of any kind caused by entering the Tournament or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded.  IN NO EVENT WILL TOURNAMENT ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, CLAIMS, ACTIONS, DAMAGES, LOSSES, ILLNESSES OR LIABILITY OF ANY KIND, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF PARTICIPATION IN THIS TOURNAMENT OR THE ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF A PRIZE. WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.  SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

 

14.       Disputes/Governing Law

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Participants, Sponsor, and other Tournament Entities in connection with this Tournament, shall be governed by, and construed in accordance with the laws of the State of Georgia, United States of America without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Georgia.  Any legal proceedings arising out of this Tournament or relating to these Official Rules shall be instituted only in the federal or state courts located in the State of Georgia, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules and/or this Tournament, and expressly waive all jurisdictional, venue and inconvenient forum objections.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

 

15.       Use of Data

Sponsor may collect personal information about Participants  through registration and participation in this Tournament to be used by Sponsor and its designees for purposes of the proper administration and fulfillment of this Giveaway as described in these Official Rules.  This may include the Tournament Operator sharing a Participant’s email address and PSN ID with Sponsor or its designees for purposes of contacting entrants about Tournament Prizes. In addition, by entering this Tournament, Participants agree to Sponsor’s use of their personal information as described in Sponsor's Privacy Notice, which is located at http://www.porsche.com/usa/privacy-policy/.  Sponsor’s Privacy Notice may be updated from time to time without notice.  Sponsor may use Participants’ information to send marketing communications regarding promotional offers and product information.
