Porsche Warranty for new vehicles

Porsche Cars Australia Pty Ltd (warrantor) grants the customer (warrantee) a three-year new vehicle warranty (warranty) for brand-new vehicles (new vehicles) sold and delivered within Australia in accordance with the following conditions with regard to all defects in materials and workmanship.

This warranty applies to all new:

vehicles with internal combustion engine (ICE),

battery electric vehicles (BEVs); and

hybrid electric vehicles, including plug-in hybrid (PHEV) and T-hybrid (T-HV) vehicles.

However, some of the provisions in this warranty are specific to ICE, BEVs and/or PHEVs and T-HV vehicles. Where this is the case, we have clearly stated this at the beginning of the relevant provision that it applies to a BEV, PHEV or T-HV (as the case may be).

The rights granted to the warrantee by this warranty apply in addition to the warrantee’s statutory rights and remedies available under the Australian Consumer Law.

“Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

For major failures with the service, you are entitled:

to cancel your service contract with us; and

to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

1. Geographic Scope

Claims under this warranty may be made worldwide, but only at authorised Official Porsche Centres.

2. Warranty Period

The three-year warranty period begins on the earlier of the date of delivery of the new vehicle by an authorised Official Porsche Centre to the warrantee or the date of initial usage or registration. The authorised Official Porsche Centre shall record the date of commencement of the period in the guarantee and maintenance booklet.

This provision applies only to PHEVs and T-HVs: The warranty period for defects in the vehicle's high-voltage battery ends after eight years or when the vehicle's mileage exceeds 160,000 km (whichever comes first). For all other defects, the warranty period is three years, regardless of the mileage. The warranty period begins on the earlier of the date of delivery of the new vehicle by an authorised Official Porsche Centre to the warrantee or the date of initial usage or registration.

This provision applies only to BEVs: subject to Section 4.2, the warranty period for defects in the vehicle's high-voltage battery ends after eight years or when the vehicle’s mileage exceeds 160,000 km (whichever comes first). For all other defects, the warranty period is three years, regardless of the mileage. The warranty period begins on the earlier of the date of delivery of the new vehicle by an authorised dealer to the warrantee or the date of initial usage or registration.

3. Prerequisites for a Warranty Claim

The warranty only applies to vehicles if and as long as they are considered road legal.

A claim under the warranty is only valid if during the warranty period all service interval work is carried out according to the specifications of the service interval display of the vehicle. A deviation from the specifications will not invalidate this warranty, provided that the deviation from the specified service intervals in terms of time does not exceed one month and in terms of the mileage of the vehicle does not exceed 1,000 km. In the event of a greater deviation, the warrantor shall be released from its obligations under the warranty, unless the warrantee proves that non-compliance with these specifications did not cause the warranty claim.

4. Validity of the Warranty Claim

Subject to the following provisions in Sections 4.2 to 4.9, a warranty claim shall be deemed to exist in the event of any defect in the vehicle. For BEVs only: this also includes excessive loss of capacity of the high-voltage battery in accordance with Section 4.1.

This provision applies only to BEVs: Like any lithium-ion battery, the high-voltage battery is subject to a physically and chemically induced ageing and wear process over its life which reduces performance and capacity over time. If a capacity measurement performed by an Official Porsche Centre within the warranty period shows that the net battery capacity at the time specified below is less than the percentage values (warranty values) specified in paragraphs a) and b) below, the proportion falling below the respective warranty value constitutes an excessive loss of capacity within the meaning of these warranty conditions:

80 % of the net battery capacity within three years or up to 60,000 km mileage after initial delivery or initial registration (whichever occurs first);

70 % of the net battery capacity within eight years or up to 160,000 km mileage after initial delivery or initial registration (whichever occurs first).

This provision applies only to BEVs, PHEVs and T-HVs: In the event of a defect in the high-voltage battery, a warranty claim will be excluded or denied if the defect has been caused by:

the high-voltage battery being permanently removed from the vehicle, improperly opened or operated independently of the vehicle; or

the high-voltage battery coming into direct contact with open fire; or

the high-voltage battery being cleaned with high-pressure or steam jet cleaners or aggressive, harsh, and/or harmful liquids have been applied.

This provision applies only to BEVs: The loss of capacity of the high-voltage battery which does not fall below the warranty values according to Section 4.1, is not covered by the warranty.

A warranty claim will be excluded or denied if the defect has been caused by one of the following:

the vehicle has been previously improperly repaired, improperly maintained, or improperly serviced, unless this has been done as a warranty service by an authorised Official Porsche Centre or Porsche Certified Collison Centre; or

Porsche’s or an Official Porsche Centre’s instructions/guidelines for the operation, handling and care of the vehicle in the latest version communicated to the warrantee, have not been followed; or

the owner or driver ignoring or not actioning vehicle warning indicators displayed in the vehicle; or

parts or accessories have been fitted or installed to the vehicle, or fuels, lubricants or fluids have been used, whose use has not been approved by Dr. Ing. h.c. F. Porsche AG (PAG), or the vehicle has been modified in a way not approved by PAG (e.g. engine or electronic control unit tuning or modification), unless the warrantee can prove that the non-approved parts, accessories, fuels, lubricants or fluids are of equivalent quality to those approved by PAG and that neither their use, nor the other non-approved tuning or modification to the vehicle, is the cause of the defect that has arisen; or

the vehicle has been improperly handled, overused (for ICE vehicles, an example is engine over-revving or over-speeding that occurs with manually shifted vehicles by an incorrect gear downshifting), or overloaded; or

the vehicle has been damaged by external causes or influences (e.g., accident, hail, flooding, animal bite, for example by an insect or rodent); or

the warrantee has not reported a defect immediately; or

the warrantee has not immediately given the warrantor the opportunity to remedy the defect.

Natural or normal wear and tear of the vehicle or its components that is not caused by defects in materials or workmanship having regard to the age of the vehicle and the total distance the vehicle has travelled, and consequential damage due to natural or normal wear and tear, are not covered by the warranty.

Any items which require replacement as a part of normal wear and tear or vehicle maintenance, including oil, fuel, lubricants and coolants, spark plugs, drive belt, including drive belt deflection roller and tensioner, clutch disc and pressure plate, shock absorbers, tyres, tyre sealant, Porsche Dynamic Chassis Control (PDCC) reservoir, brake pads, brake discs and wear sensors, refrigerant gas, all bulbs (excluding Xenon and LED lamps) and fuses, batteries, fair wear and tear on the High voltage (HV) battery, including reduction in performance and capacity commensurate with its age and usage, wiper blades, floor mats, fire extinguisher are not covered by the warranty.

Non-mechanical items, visual and acoustic concerns, including normal wear and tear that may develop having regard to the age of the vehicle and total distance the vehicle has travelled (for example cracks or wrinkles in the leather or trim, faded or discoloured exterior trims and lighting lenses, sounds and rattles etc.) are not covered by the warranty.

Defects which occur as a result of use, or testing in preparation for use, for motor sport including, without limitation, racing or rallying, for reward or otherwise, are not covered by the warranty.

Vehicles used as a hire car or for conveying passengers for a fare, are not covered by the warranty.

5. Services in the Event of a Warranty Claim

In the event of a valid warranty claim, the warrantor shall have the defect remedied free of charge by an authorised Official Porsche Centre (rectification).

The following only applies to BEVs: In the event of an excessive loss of battery capacity, this will be remedied free of charge for the customer in such a way that the respective warranty value is reached again. For example, if the net battery capacity is 65 % for a vehicle that is seven years old and with a mileage of less than 100,000 km, then a net battery capacity of 70 % must be achieved as part of the defect rectification.

Within the scope of rectification, the warrantor may, at its own discretion, either replace or repair defective parts. The parts installed or repaired within the scope of the rectification of defects shall be covered accordingly under the warranty until the end of the period of the Porsche warranty for new vehicles. The old parts removed within the scope of the rectification shall become the property of the warrantor subject to a deviating agreement in the authorised Official Porsche Centre specific workshop order.

To the maximum extent permitted by law, neither party will be liable to the other for any consequential, indirect, incidental costs, loss or damage arising out of or in connection with this warranty, whether in contract, tort (including negligence), statute or otherwise. For the avoidance of any doubt, the warranty does not cover claims for vehicle loss of usage, nor for loan or rental vehicles.

Claims based on intentional or grossly negligent conduct by the warrantor, its legal representatives or its vicarious agents and claims based on injury to life, limb or health shall remain unaffected.

Any expenses associated with a warranty claim are to be borne by the warrantee. The cost of testing, measurement, adjustment and cleaning work relating to warranty claims which are refused under the terms of this warranty must be paid for by the customer (unless waived by the Official Porsche Centre in its discretion).

6. Processing of the Warranty Claim

In order to avoid any consequential damage, the warrantee is obliged to notify an authorised Official Porsche Centre of a defect immediately after it first occurs, to have the authorised Official Porsche Centre record the defect and provide it all necessary information, and to make the vehicle available to the authorised Official Porsche for the recording and repair of the defect. A list of authorised Official Porsche Centres can be found on the warrantor’s website (www.porsche.com.au).

If the vehicle becomes inoperable due to a defect, the warrantee is obliged to contact the nearest authorised Official Porsche Centre, who will decide whether the necessary work is to be carried out on site or in its workshop. Possible claims by the warrantee under Porsche Assistance remain unaffected by this obligation.

In the case of vehicles whose maintenance history cannot be digitally traced, the warrantee must prove that all service interval work has been carried out in accordance with Section 3.2 by submitting the fully completed service record in the warranty and maintenance booklet or corresponding workshop invoices.

7. Transfer of the Warranty

In the event of the sale of the vehicle, the warrantor agrees to the assumption of the warranty contract by the new purchaser. The new purchaser takes the place of the warrantee and assumes the warranty to the extent and with the remaining warranty period existing at the time of the assumption.

8. Limitation

Where a warrantee notifies an authorised Official Porsche Centre of a potential claim during the warranty period, the warrantee must liaise with an authorised Official Porsche Centre so that the claim is rectified within 6 months of the warranty expiring otherwise the claim will lapse or expire.

9. Final Provisions

The warranty and its interpretation shall be governed by the laws in force in Victoria. The parties submit to the non-exclusive jurisdiction of the courts of Victoria.

Porsche Paint and Long-term Warranty for New Vehicles

In addition, the warrantor provides the following warranty with regard to the vehicle’s body:

a three-year warranty against defects in the paintwork (paint warranty); and

a twelve-year warranty against corrosion (long-term warranty). For the purposes of the long-term warranty, corrosion means a perforation to the metal on the vehicle’s body that has progressed from the inside (cavity) to the outside.

The warranty period begins on the earlier of the date of delivery of the new vehicle by an authorised Official Porsche Centre to the warrantee or the date of initial usage or registration.

All terms of the Porsche warranty for new vehicles stated above, insofar as applicable in terms of content, shall apply in the same manner to the paint and long-term warranty.
